The Ohio Department of Commerce, Division of Industrial Compliance (“Division”), is responsible for ensuring every elevator within its jurisdiction operates in a safe manner that complies with applicable law, including Chapter 4105. of the Revised Code and Chapters 4101:5 and 1301:3-6 of the Ohio Administrative Code. Depending upon the severity of the violation at issue, the Elevator Code permits an elevator to be removed from service until the violation has been corrected. The Elevator Code, however, does not require that such an elevator be returned to service. If a building owner elects to not correct the violation, the elevator will simply remain out of service until the violation is ultimately addressed. Although the elevator is still subject to state inspections, it is not within the Division’s jurisdiction to require that the violations be corrected, and the elevator be placed back into service.
